ORDER granting 9 Motion to Dismiss; denying 10 Motion for Leave to File. SO ORDERED that the branches of defts' motion seeking dismissal of plaintiffs first through third causes of action as time-barred are granted and deft's first th rough third causes of action are dismissed in their entirety with prejudice pursuant to Rule l2(b)(6) of the Federal Rules of Civil Procedure as time-barred; the branch of defts' motion seeking dismissal of plaintiffs fourth cause of action purs uant to Rule l2(b)(6) of the Federal Rules of Civil Procedure is granted and plaintiffs fourth cause of action is dismissed in its entirety with prejudice for failure to state a claim for relief; and plaintiffs cross motion seeking leave to amend his complaint pursuant to Rule 15(a)(2) of the Federal Rules of Civil Procedure is denied.
