Filing 20 EO: On 8/29/2024, pro se Plaintiff Mike Camacho ("Plaintiff") initiated this action by filing his [ECF #1 ] Complaint. The Rule 16 Scheduling Conference is set for 10/28/2024. The docket fails to reflect service on any of the eleven defendants. Moreover, to date, no defendant has appeared, answered or filed a responsive pleading. Pursuant to Rule 4(m) of the Federal Rules of Civil Procedure, service must occur within 90 days after the complaint is filed. Absent a showing of good cause, failure to timely serve defendants may result in sanctions to include possible dismissal of this action. Recently, mail transmitted by the Court to Plaintiff's address of record has been "returned as undeliverable." ECF Nos. 18 & 19. Pro se litigants whose mailing address changes while appearing in any pending case "must file with the Court and serve upon all other parties... a Notice of Change of Address within fourteen (14) days that specifies the effective date of the change." Local Rules of Practice for the United States District Court for the District of Hawaii ("Local Rules" or "LR") 83.1(e)(1) (emphasis added). Failure to comply with this may result in sanctions, including dismissal when a document sent to the pro se litigant by the Court is returned to the court as undeliverable and the Court fails to receive, within thirty (30) days of the returned document, a written communication indicating a current address for service. LR83.1(e)(2). In this case, Plaintiff has failed to file a Notice of Change of Address. Nor has he filed a document that clearly communicates a different address for service. "Pro se litigants shall abide by all local, federal, and other applicable rules and/or statutes." LR81.1(a). "Sanctions, including but not limited to . . . dismissal with prejudice, may be imposed for failure to comply with the Local Rules." Id. In light of the foregoing, the Rule 16 Scheduling Conference scheduled for 10/28/2024 is CONTINUED to 12/17/2024 at 8:45 a.m. before Magistrate Judge Trader. Scheduling Conference Statements are due 12/10/2024. Parties and other participants must call-in at least five (5) minutes prior to the scheduled start time of the conference.
